Проводится сравнительно-правовая характеристика механизма договорного регулирования отношений, связанных с осуществлением родительских прав и исполнением обязанностей при раздельном проживании ребенка одним из родителей. Анализ соответствующих положений семейного законодательства Российской Федерации Республики Беларусь позволил автору выявить как общие, так отличительные черты, демонстрирующие наличие конкуренции соглашений. The author conducts a comparative legal description of the mechanism contractual regulation relations related to exercise parental rights and performance duties when child lives separately from one parents. An analysis relevant provisions family legislation Russian Federation Republic Belarus allowed identify both common distinctive features, demonstrating at same time presence competition between agreements.
